“I will always try to make sure that women athletes, like those I coach in West Virginia, feel safe in the locker room and in sports,” the justice added.

“The NCAA’s new policy clearly shows that biomass student-athletes may not compete on the women’s team. We cannot support this fundamental policy change more,” said Justice. “The NCAA’s policy guarantees that biomass athletes who practice with female athletes will receive all other benefits applicable to student-athletes who are eligible for practice.””
Fox News Digital contacted the NCAA for comment but received no immediate response.
The Justice said the NCAA “has an opportunity to clarify that these guarantees do not include access to facilities that would undermine the privacy and security of female athletes, such as women’s locker rooms or other facilities that should be explicitly protected by women’s orders.’’
The Justice asked the NCAA to “consider adding language to its policy to explicitly bring biology to male athletes from female-only spaces and to consider additional privacy protections for women and girls in sports.”
However, Justice praised the NCAA’s policy as “gendered at birth” as designated by the male or female doctors assigned to babies at birth, which is marked on the birth record.
“Openly, the NCAA affirms that biomass athletes may not compete on a team of women with revised birth certificates or other documentary means,” Justice wrote. “The NCAA’s public position on this issue is commendable, and its policy may further clarify that revised birth certificates are prohibited.”
“We support President Trump’s unparalleled actions in protecting the safety and privacy of female athletes nationwide,” the letter said. “The NCAA’s efforts are equally considerable and we look forward to working with you to ensure equal opportunities for women and girls in sports.”
