The agency announced Wednesday that it is “updating the USCIS policy manual to clarify that it recognizes only two biological genders”.

The agency said the policy changes were made under executive orders, which signed on the day President Donald Trump took office to “defend women from gender ideological extremism and restore biological truths to the federal government.”
According to the U.S. Citizenship and Immigration Services, USCIS believes that a person’s gender is usually proven in a birth certificate at birth or closest to the time of birth. “If a birth certificate at or closest to the time of birth indicates a gender other than male or female, the USCIS will be determined based on the gender of secondary evidence. ”

Last year, immigrants were able to choose The third gender option, or “X” when applying for naturalization.
“Historically, USCIS forms and related documents offer only two gender options: ‘Male (M)’ and ‘Female (F). This creates a significant obstacle for applicants who do not agree with both options,” the U.S. Citizenship and Immigration said at the time. “Limiting welfare requesters to two gender programs can also create administrative challenges to USCIS when we receive a birth certificate or other official government-issued documents.”

“Adding a third gender option helps ensure that secure identity files and biographical data are accurate and helps external stakeholders and individuals demand immigration benefits. This is also consistent with federal and state agencies that adopt a third gender option, such as the U.S. State Department’s expanded passport service offering gender X in its app,” it added.
