Co-hosts on Tuesday’s ABC Daytime Talk Show Alyssa Farah Griffin Asked Sotomayor if Trump could seek a third term.
“Donald Trump may seek a third term. This is my personal belief that if he does, the Republican Party may support him. I want to ask you: Obviously, the 22 Film Amendment prohibits someone from seeking a third term. Do you believe the 22nd Amendment is a settlement law?”
“The Constitution is settlement law,” Sotomayor replied. “No one is trying to challenge this. You don’t know until someone tries. So it doesn’t solve because we don’t have a court case on this issue. But it’s in the Constitution, and people should understand that there is nothing bigger than the U.S. Constitution.”

As Hostin explains on the podcast, Sotomayor’s view that it has never been tested bothers her.

“Is it blurry?” Behar asked.
“No, it’s not vague. I think it’s obvious. She said it’s not tested yet. There’s no situation.”
Behar added: “Everything he did overwhelms or goes beyond anything in the Constitution – because he didn’t follow the rules. And it didn’t do it. No one did anything he did.”
