“The Constitution is very clear that federal laws (such as Title IX) take precedence over state laws,” Gaines said. “Even if President Trump returns to the White House, awakening the war has not yet won.”

Maine has become the battlefield for the issue after Maine Gov. Janet Mills and Trump fought a verbal war on the issue. Additionally, Republican Maine Legislative Councilor Rep. Laurel Libby was condemned Tuesday for attracting the attention of trans high school athletes in social media posts, ranking first in the women’s pole vault competition.
Gaines praised Libby and defended the lawmakers while condemning Mills.
“[Mills] “I would rather lose more than $5 billion in federal funds to send the message the boy deserves and have the right to trample on the girl in the process,” Gaines said. “I commend it, I am very proud of Rep. Libby, and very grateful. Just looking at this, watching a female representative lose her ability to vote and speak on the floor of the House to defend girls and women.
“No, this did not happen in Afghanistan. This happened in the United States.”
In addition to Democrats in states such as Maine and California, the NCAA has also been criticized for its recent revisions to its gender qualification policies to comply with Trump’s orders. Many critics, including Gaines, pointed out that the NCAA’s new policy did not consider a revised birth certificate, noting that 44 U.S. states allow gender changes on birth certificates.
Gaines, the brand ambassador’s clothing brand XX-XY Athletics, launched a video ad on Wednesday, with multiple female college athletes clamoring for NCAA’s policies, insisting that it’s not far enough.

“We worked with XX-XY Athletics to post this ad directly to the news (NCAA President) Charlie Baker, who posted it directly to the NCAA,” Gaines said. “They issued a policy after President Trump’s executive order claimed to be in trouble, but the NCAA policy directly clashed with Trump’s exquisite and thorough executive order.”
Gaines will travel to Minnesota next week to advocate for a state bill that bans trans athletes in women’s sports there.
