Bird, a Republican, believes the sheriff’s “long-term” stance of the detainee-based immigration enforcement action “hinders cooperation with federal immigration authorities’ violations of Iowa laws.”

Nevertheless, Winneshiek County Sheriff Dan Marx promised not to work with Ice detainees in a February 4 Facebook post, asserting that the detainees were “unconstitutional requests only from ICE”.
In the now-deleted post, Marx encouraged people to contact his office when they encountered “any federal agent” and said that he and his staff “always willing to assist in verifying the certificate, and the legitimacy of any paperwork federal agents must make sure your rights have not been abused.”
“If the Fed’s actions and paperwork are within the constitutional parameters (such as appropriate valid judicial orders/court orders), we will help if needed or required to ensure that their actions are professional, minimally.”
He continued: “If their actions or paperwork are not within the constitutional parameters, then we will do everything we can to stop, intervene and interrupt their actions and thus move forward.”

The sheriff’s claim that actions not within the scope of constitutional parameters include what he calls “non-judicial review” “he claims “this is just an unconstitutional request for arrest or possession of someone by ICE or three other letters by federal agencies.”
“The only reason for issuing detainees is that federal agencies do not have enough information or take time to obtain valid judicial decrees,” Marx claimed.
“In short, they are not sure they are detaining the right person and need more time to figure this out, those detainees violated our Fourth Amendment protections to prevent unauthorized searches, seizures and arrests and our Sixth Amendment,” he said.
Marx said in a long post that his “long-term position of not knowing the detainees” and his involvement in immigration enforcement will be based on “constitutional standards… not opinions, politics or emotions.”

This sparked an investigation, and Bird found that despite his disobeying rhetoric, Marx’s office has complied with “every ice detention request” since 2018.
The Attorney General gave Marx a deadline last week to amend his statements to comply with state law. When he refused to make the correction, Bird launched a lawsuit to remove all state funds to Winnisk County until the sheriff agreed to comply with state laws regarding state laws in cooperation with federal immigration authorities.
Byrd believes that Marx’s position “violated Chapter 27A of the Iowa Law Code,” she said “are filled with legal and factual errors in enforcing immigration laws.”
The lawsuit was filed in the Polk County District Court, citing Section 27a.4 of the Iowa Law Code, which states that the county “cannot obtain any state funding” if a local entity intentionally violates this chapter.

Commenting on her suit, Bird said: “Under Iowa law, shelters are illegal.”
“Sir Marx had the opportunity to withdraw his statements, comply with the law and respect the Ice Detention Center, but he refused — even to pay the price of his hometown,” she said. “He had no choice but to bring the case to the court to enforce our law and ensure cooperation with the federal immigration authorities.”

Representatives of the Winneshiek County Sheriff’s Office declined a request for comment from Fox News Digital, saying the sheriff and the office “cannot provide any comment at this time due to pending litigation.”
Winnishiek County auditor Benjamin D. Steines will not disclose how much money the county will lose, citing the same lawsuit.
“Iowa is not a shelter for illegal immigrants. Bird told Fox News that anyone who threatens to “stop, interfere and disturb” immigration enforcement will be held accountable.

She noted that her office “gives the sheriff the opportunity to resolve his state legal violations and work with immigration enforcement, but he refused – knowing that it would cost his family community.
