“Their comments do not reflect our values or mission. We are committed to responsibility and respect for all.”
Berry was previously listed as an advisory board member on the Foundation’s website. The statement does not name Berry or mentions Kirk’s killing directly. Fox News Digital contacted the organization to clarify whether Berry was terminated.
Ohio State Rep. Adam Mathews shared the foundation’s statement on social media and confirmed to Fox News Digital on Tuesday that Berry is a member of the foundation’s terminated advisory board. Republican lawmakers have previously issued a statement asking the judge to resign after social media commented that Matthews said celebrating Kirk’s killing “in vulcanization, racial discrimination and political language.”

“Judges have to be the backbone of fairness and justice in our community,” Matthews said. “Seeing a current judge comments like ‘Hate and Dividing!’, asking ‘How does he feel about gun violence and gun control in hell?’, and then by saying ‘This way the race of the killer was celebrated, so, a white man killed him! Shocking and totally unacceptable.”
He continued: “This is not the act of a legally neutral arbitrator; it is the act of a political activist that abandons the core principles of his office.”
Matthews warned that if Berry did not resign, he would file a formal complaint with the Ohio Supreme Court’s office of the Discipline Attorney.

Berry will retire in January 2026, he told Cincinnati Inquirer He does not “forgive any kind of violence of any human being.”
“If I cause division, I’m sorry.” “That’s not my intention. I hope there can be peace.”

Fox News Digital could not contact Berry for comment. Hamilton County Democratic Chairman Alex Linser told Fox 19 In response to Berry’s “disappointing and divisive comments”, the judge will be recognized in an upcoming judicial event.
In a statement to Fox News Digital, Mathews praised Linser’s response and updated the judge’s call for resignation.
“As a follow-up, I’m happy to see Democratic lawyer and chairman Alex Linser oppose Ted Berry’s behavior, lifting Berry out of the upcoming fundraising celebration of the judge. It was the right decision. It was the right decision. The condemnation of his horror and race is something we can resign.”
