Lata County Deputy Attorney Ashley Jennings wrote in court that Judge Steven Hippler was asked to exclude any potential witnesses from Koberg’s family from trial before making his own testimony.
“The state can call on members of the Koberg family to testify at the trial,” she wrote. “Before the trial begins, the state is expected to motion the court, otherwise the court will exclude witnesses from the court as required by the court in order not to hear testimony from other witnesses.”

Jennings believes that while the victim’s relatives guaranteed legal rights, nothing can provide the defendant’s family with the same rights.
“The defendant demanded the same rights as the victim’s family.” “However, the ‘immediate family of the victim’s homicide’ enjoys constitutional and statutory rights,” Jennings continued. [the] Idaho Constitution…There is no comparable constitution or statutory provision that provides these rights to the defendant’s family. ”

Koberg’s defense attorneys asked his family to be included in the priority seat earlier this month after prosecutors filed a list of relatives of the victims in the court.
Defense attorney Elisa Massoth claimed that excluding them would violate his Sixth Amendment rights. But Jennings shot down this logic.

“The defendant has the constitutional and legal rights to ‘open trial’, but this does not extend to the person the defendant chooses to sit in court,” she wrote.

According to court documents, the victims were identified as Madison Mogen, 21, Kaylee Goncalves, 21, Xana Kernodle, 20, and Ethan Chapin, 20.
Police found The Ka-Bar scabbard under Mogen’s body, allegedly putting Kohberger’s DNA on it. Prosecutors also claimed that surveillance videos of suspicious vehicles and Kohberger’s phone records helped put him on the scene.

The defense did not object to the existence of the victim’s family in court, but Koberg’s attorneys asked the judge to prohibit the judge from dressing in court with the victim’s face, thus sweeping the Goncaves family once.
