Law firms with a history of so-called racial discrimination practices will be banned from working with the state unless they show significant changes, the memo said.

The ban targets law firms involving several types of dei Programs, including those with Mansfield certification, require diversity in leadership positions; minority diversity scorecards; and racial diversity goals for recruitment, promotion and contract goals.

“My office will immediately begin a review of existing external attorney participation to assess compliance with this policy,” Uthmeier said.

When reviewing its attorneys, AG’s office will also consider “excellent” individual attorneys who “personally reject DEI and ESG Rouses,” even if they are part of a law firm that owns the DEI program.

Other practices under review include diversity scholarships limited to specific racial or ethnic groups, diversity coaching programs, DEI-centered recruitment sites, and workplace DEI training, “so mean that it forms a reasonable basis for hostile work environments or allegations.” Companies participating in third-party diversity programs such as the Legal Diversity Committee may also be disqualified, as well as environmental, social and governance (ESG) framework.
