Wilcox’s lawyers insist that Congressional regulations require that NLRB board members be removed from office only for neglect of duty or malfeasance, while Trump attempts to remove him without reason. According to the plaintiff, Trump was the first president to try to evacuate NLRB members.

Howell noted that the president has broad powers under Article 2 to make personnel decisions within the executive branch, asking attorney Wilcox to step in and block those powers within the powers of federal judges.
Deepak Gupta argued for Wilcox: “Congress was also elected as the elected king. Congress made laws. The president enforced these laws.”

Justice Department attorney Harry Graver argued with the government and agreed that the president did not attempt to fire Wilcox for malfeasance or neglect, but rather that the president had the right to hire and fire within the government.

Howell seems to be in Graver’s The presidential power perspective. “Is anyone in the executive branch removed from office by the president? This is the most extreme version of the unified implementation theory I have ever heard of.”
Howell accepted the debate and briefing and is expected to make a ruling in the coming days. Currently, Gwynne Wilcox is still not working, and NLRB still has no quorum, so any labor disputes cannot be resolved.
