In Sunday’s 22-page judgment, the federal judge called Kilmar Armando Abrego Garcia’s deportation “completely illegal.”
Abrego Garcia, 29, was deported to El Salvadoran Megaprison last month for allegedly being a member of the MS-13 gang. U.S. District Court Judge Paula Xinis ordered DHS and DHS secretary Kristi Noem to return Abrego Garcia to the United States where he lives in Maryland.
“Although the legal basis for mass-to-billion hundreds of people to El Salvador remains unsettling, the case of Abreg Garcia is clearly different – there is no legal reason to arrest him, detain or dismiss him,” Sinis wrote.
She continued: “There is no evidence that Abrego Garcia was held at Cecot at the request of the El Salvador authorities to answer the crimes in that country. Instead, his detention seemed entirely illegal.”

Also on Sunday, the Attorney General Pam Bondi The Trump administration has decided to double Abrego Garcia’s decision.
“We have to rely on what the ICE says,” Bondy said in an interview on Fox News Sunday. “What we have to rely on Homeland Security explain. They are our customers and I firmly believe in the work they are doing and we will once again ensure America is safe. That’s what President Trump has directed to all of us. ”

Abrego Garcia then married an American citizen and worked in construction to support her, their son and two children in previous relationships.
The allegations about his affiliation with MS-13 stemmed from a 2019 arrest outside the Home Depot store in Maryland, where he and other young people are looking for jobs, the Associated Press reported.

Abrego Garcia was arrested on March 12 in Baltimore after working in a metal apprenticeship class in Baltimore and picked up his 5-year-old son, who had autism and other disabled sons from his grandmother’s home, according to a complaint from the lawyer.
