The panel found that the government did not show great success in the merits of the appeal, and if they did not grant accommodation, nor did they show irreparable harm – meeting the legal requirements required for emergency court intervention.
The third ruling revoked a decision brought 10 days in advance by a panel of three judges in the same court of appeals. The panel ruled the Trump administration 2-1 and allowed the shooting to proceed, prompting the plaintiff to file a request from the Court of Appeal to hear the case again, or with all the Court of Appeal judges.
The appeals court’s decision to retry the case, even after the three judges in the same court’s appeal panel were ruled late last month, Trump and his allies could be under severe scrutiny.
Again, this almost ensures that the Trump administration will quickly bring the matter to the Supreme Court for an emergency review.
