Jonathan Caravello, 37, of Ventura, was indicted by a federal grand jury on a felony assault after prosecutors said he picked up the tear gas canister that an officer shot and shot it at them.
Caravello was initially charged with felony assault in a criminal lawsuit filed on July 12, with the criminal complaint being demoted to a misdemeanor, to which he pleaded not guilty. The case was then sent to a grand jury for consideration.
Caravello was one of four U.S. citizens arrested in an immigration raid on suspicion of attacking or resisting officers, according to the Department of Homeland Security.
