“For decades, the TPS program has been abused, exploited and politicized into a de facto amnesty program. The use of the country has become even more dangerous given millions of uncensored illegal foreigners,” a DHS spokesman said in a statement to Fox News Digital.
“Although the order delays justice, [DHS] secretary [Kristi] “Neum will use all the legal options that the department disposes to end this chaos and determine the safety of Americans. Unelected activist judges cannot prevent the will of the American people from obtaining a safe and secure homeland.”

“The case was urgently taken by current Department of Homeland Security Secretary Kristi Noem, revoking the legal status of TPS holders in Venezuela and Haiti, putting them in such dangerous conditions that even the State Department advised against traveling to their own country,” the judge wrote.
TPS was awarded to Venezuelans and Haitians under the Biden administration as a qualifier for immigration from a country, including active wars or major public health crises in their hometowns.

“The environmental conditions in Haiti have improved enough that it is safe for Haitian citizens to return home,” a spokesperson for the Department of Homeland Security said in July. “We encourage these people to use the department’s resources to return to Haiti, which can be arranged through the CBP home application. If eligible, Haitian nationals may pursue legal status through other immigration welfare requests.”
