Appeals court blocks Trump from firing Fed’s Lisa Cook, setting stage for SCOTUS clash

U.S. DC Circuit Court of Appeals Blocked President on Monday Donald Trump From the immediate sacking of Lisa Cook in the Fed Bureau post, the latest battle in the high-risk court struggle will almost certainly appeal to the Supreme Court quickly.

The 2-1 ruling of Judges Gregory Katsas, Michelle Childs and Brad Garcia was in a lower court order signed last week by U.S. District Judge Jia Cobb, which restored her position on the Federal Reserve Committee.

In a preliminary injunction last week, Justice Cobb said Trump’s attempt to open fire could violate the Fed Act and Cook’s due process protection. The decision prompted the Trump administration to file a lawsuit in the High Court for emergency relief.

“When the governor erodes the foundation of this confidence with misconduct or serious neglect, the president passes action and acts legally by removing them,” the Justice Department attorney said in an appeal to the U.S. Court of Appeal.

The 2-1 ruling of the Court of Appeals is a recent blow to the Trump administration. Trump announced on social media last month that he would fire Cook from the independent Fed’s board of directors due to allegations of mortgage fraud.

Cook’s lawyers immediately sued Trump for his attempt to remove her before the end of his 14-year term, believing he had no reason to do so. Cook denied any misconduct.
