A federal judge refused to block the ICE from arresting immigrants in New York City Immigration Court and ruled Friday that the expansion of new Trump policy for court arrests does not appear to violate any law.

The result is partial victory over immigration rights groups, which complain about the Trump administration’s attempt to expand arrests and deportations.
Several arrests in the New York Immigration Court have spread, with activists accusing our immigration and customs of carrying out “kidnappings” appearing in defending their claims of shelter or otherwise defying what should also be allowed to stay, despite their illegal immigration status.
The radicals say the government shortens immigration cases by judges dismissing immigration cases, opening up avenues for ICE officials to arrest and deport under accelerated dismissal procedures, and deportation can be carried out without the order of an immigration judge within two years of illegal entry.
Justice Castell said that despite the judge’s authority to approve the dismissal, the Justice Department was wrong, crafting a policy that forced them to do so to promote ice arrests.
He said the ICE hoped there would be more arrests that did not meet legal standards and he issued a stay.
But he said Ice appears to have legally entitled to arrest more courts on its own.
The Trump administration issued guidance to ice officials and agents in May, including all courts, including immigration courts, which are part of the executive branch, not the judiciary.
As long as there is reliable information to support it, this new policy specifically grants ICE the power to conduct immigration arrests “in or near the court.”
The new guidance has replaced Homeland Security Secretary Alejandro Mayorkas from 2021, who dissuaded the court building to arrest and said they might scare the cright to send immigrants to show up.
Judge Castell said the new Trump policy “balances” different things, but is not illegal.
“The agency noted that the courts were safe places to arrest due to safety screening. It also explained that alternative places to arrest, correctional facilities or prisons for arrest are unavailable due to state and local policies. Implicitly stated that the agency believes that its new policies are better,” the judge wrote.
