The federal appeals court put the Trump administration allowed the payment of Medicaid from Planned Parenthood and ruled on Thursday that it was too early for the lower court lockdown.
The pause of money is part of President Trump’s large billing budget law in July.
The Planned Parenthood chapter argues – Judge Indira Talwani appointed by Obama – agreed – the law unfairly addressed abortion providers.
But the appeal panel of the three judges, all of whom Biden appointed, is different about it and says the administration may have a better argument. The court issued Judge Talvani’s ruling and allowed the money to be blocked as the case proceeded.
The Court of Appeal said under an unsigned order: “Although the District Court reached the contrary conclusion after careful consideration of the matter, we concluded that the defendants assumed their burden to show that they were entitled to the suspension of the scheduled proceedings until the appeal proceedings.”
Cutting federal funding for Planned Parenthood has been a major goal for Republicans for years.
They achieved this in the budget law, which made significant changes to the government health care program for the poor, which is mainly funded by Congress and administered by each state.
Judge Talvani said the law involved retaliation against family planning advocates for “reproductive freedom.”
