James Quadra, Cervantes’ attorney, said Sacramento police had tried to “destroy the reputation of the state Senate model members” and that the department’s “despicable misconduct” included false arrests, intentionally causing emotional distress and slander.
Representatives of the Sacramento Police Department declined to comment, citing a pending lawsuit.
After the crash, the Sacramento Police Department told reporters that after talking to Cervantes at the hospital, they “observed objective signs of poisoning.” She said in her filing that police asked her to test to measure her eyes’ response to irritation, which was “accurate and subjective test” rather than the blood test she requested.
The document says the toxicology screen “completely exempts” Cervantes, but the police department has “released false information to the press, claiming that Senator Cervantes is driving under the influence of drugs.”
A policeman closed it for about five minutes when answering the call, the document said. The document also said the department failed to make body camera lenses from sergeants who also came to the hospital.
