Sean Higgins, the man accused of death NHL Stars Johnny Gaudreau and his brother Matthew will be tried this summer after a New Jersey judge denied his defense attorney debate that the brothers’ drinking would lead to their death.
High Court Judge Michael Silvanio made a ruling in court Tuesday after nearly two hours of debate, and finally decided on all Fees for Higgins Will be maintained.

“There is no trust in this argument, and there is an oversight of contributions for cyclists,” Silvanio said.
Assistant Attorney Michael Mestern added at the hearing that the defense’s argument was “to say the least.”

According to court records, Johnny and Matthew Gaudreau were riding a bike along a road on the eve of their sister’s wedding, blood alcohol levels were .129 or higher.
They were killed when Higgins allegedly hit them with a vehicle while trying to pass through the vehicle on the right. But witness testimony supported the brothers’ reckless bike ride.
“Four witnesses witnessed the defendant riding on the Mustang to the right when he hit the brothers and illegally passed the Mustang. Witnesses also saw the brothers riding a single file on the fog line, riding traffic on the fog line before being hit by the defendant.”

Higgins’ blood alcohol content is .087, and the statutory limit in New Jersey exceeds the .080 limit.
He was charged with two counts aggravated crime of manslaughter, Two counts of vehicle homicide, evidence tampered with and leaving the scene of the accident. He also admitted to police that he had been drinking that day, including while driving.
Higgins’ lawyers said the motion was not to blame the brothers, and argued that the grand jury had not heard all the facts before approving the charges.

Higgins pleaded not guilty in January and could face up to 70 years in prison if he was found guilty on all charges. He will return to court on June 10.
