one Federal Judge On Friday, the Trump administration demanded the dismissal or move of a case involving a doctoral student at Tufts University, which was detained by immigration authorities rather than moving the proceedings to Vermont.
Judge Denise Casper denied the government’s request to dismiss Rumeysa Öztürk’s case or move it to western Louisiana.
Casper’s order states: “Although the petition raises serious questions about the arrest and detention alleged in these charges before the merits of the petition are reached, the court must first resolve the dispute between the parties regarding their jurisdiction.”
It continued: “The court denied the government’s motion to dismiss the petition or handed over the matter to the western Louisiana area and relied on “the interests of justice” … to transfer the matter to Vermont when Ozturk was restricted overnight in the petition application.”

The hearing was held in the Federal Court of Boston to determine whether a petition for habeas protection, representing Öztürk, had been submitted for the correct jurisdiction.

In March 2024, Öztürk co-wrote the Tufts Daily column, calling on the university to evacuate from Israel.
Massachusetts lawyers at Öztürk accused the Trump administration of “forum shopping”, saying ICE moved students to Louisiana, where the court could be detrimental to her case.
The U.S. Attorney’s Office argued that federal authorities moved Öztürk to Louisiana because Massachusetts did not have space available to hold her until trial. They said she was sent for the first time Go to Vermontbut later moved to Louisiana.
